part of DOMA declared unconstitutional

a ruling came down from federal court in Massachusetts today on two cases challenging DOMA.

I don't think it says in this article, but I believe this is only a ruling on section 3 of DOMA (the part that says the feds don't recognize legal marriages), not section 2 (the part that says other states don't have to recognize them).

    I don't know but NY isn't taxing my insurance (I'm on K's) anymore.  We still have the imputed income to deal with.  But, a few months back they starting taking out my health insurance pre-tax.

    I have NO IDEA if PA is taxing my insurance Embarrassed

    but the Fed cost on C's coverage (she's on my plan) is almost 90/mo.

    But my coverage is awesome, so though we're spending $50 more/mo than we did seperately, all but the copays of the TTC has been covered, so worth it thus far!

    if I had to guess I'd say this isn't because of any ruling, it's because of Jelly Bean. if K pays one rate for family health insurance regardless of how many people are on it, and she is a legal dependent, then they could be figuring her as the one who the money is going toward instead of you. if that makes any sense...

    I doubt it unless you live in a state where your marriage is legally recognized. there aren't any IRS laws about DPs, only spouses--but who knows.

    I would have thought that too, but this started before we switched to a family plan.

    I wonder what the case would be in NJ (when we move) where gay marriages are recognized as civil unions and have full spousal rights w/in the state.

    probably moot.

    Do you get taxed on the whole thing non-Carol portion, or just your portion ?  Im basically wondering if we get family coverage under me if the me + kid part will be pre-tax.
