They're not breaking any laws. The USDA is very pro-big agriculture, they promote Monsanto every chance they get. Really, this all stems back to whatever %^&$#^$ patent lawyer and his boss who decided you could patent a gene within a plant, and therefore patent the whole plant. And didn't place prohibit Monsanto from SUEING for unintentional discovery of said gene that was transferred by the WIND.
