State of RI Employee - maternity leave?

Does anyone know what the policy is for state workers who need to take maternity leave?  I have heard they don't pay into TDI so they may have to take 13 weeks unpaid under FMLA if they don't have enough sick time accrued.....

Re: State of RI Employee - maternity leave?

  • I am under the impression that there isn't a uniform policy for state employees (b/c there are so many unions and they all have different policies).

  • I can kind of answer your question.

No you don't get TDI if you work for the state as they do not pay into TDI. HOWEVER. I do believe if you have the AFLAC or other STD coverage that will cover your 6-8 weeks of maternity.

Federally, you are allowed 13 weeks unpaid leave no matter which employeer you work for (as long as the company has 50 employees working in the same state).

I do not know if the union you/whoever works for has additional things in place for you. Some unions allow up to a year off w/o pay, some have 6 weeks paid. It all depends. The steward would be the best person to ask for that particular area.

Also, no idea if you're not in a union. :( Sorry, hope that helps.

  • I am a state employee and actually on maternity leave right now.  I am in Union 580...I'm not sure how this policy differs from union to union.  You are able to take up to a year of leave, and they will hold your job.  You have to use your sick/vacation time and when that runs out you go unpaid.  If you opt to pay into AFLAC they will pay you 6 weeks for vaginal birth and 8 weeks for c section.  There are different plans...depending how much you pay in depends on how much you get paid and what the waiting period is.  You have to be signed up for AFLAC 10 months prior to giving birth.

Let me know if I can answer any other questions for you.

  • What if you worked for a company that you DID pay into TDI prior to working for the state? Would you be allowed to use the TDI money from your prior job (if it's within the same year or so)??  Just curious for that all works..
