I just saw on FB that a home based business person said that she has to stop making "tag" type blankets because apparently it is PATENTED (insert huge eye roll) and the company is suing small businesses.
So I'd just make sure not to sell those on your Etsy

Well, the lady who I bought Brody's "taggie" lovey for $5 at a craft sale better look out! :::eye roll::: Does that mean they're going to sue the quilt shops that are selling patterns to make these as well? My mom has made Brody 2 other taggie loveys; she didn't need a pattern but said that she did see some in the stores.
It's find for your mom to make one, I think it is the "selling" it that is the issue.
There are some FB women that have shops that are being sued and I'm sure they aren't making HUGE money off of their taggie blankets anyways.

Yep. The Taggy Blanket company apparently has superb patent lawyers. They basically have any loop of ribbon between 2 layers of fabric patented. So if I were to make a stuffed giraffe, and use loops of ribbon for the mane, can't sell it. They have the patent on that, not just blankets. Good for them, not for crafters. And, they are serious about it. Many etsy sellers have been sent cease and desist (sp?) letters. For the ones who want to still sell the blankets, they basically had to snip the loop with scissors, so now it is just 2 ribbon pieces sticking out from the seam.
Yes, alot of crafters (I am guesing ones who do not sell on etsy etc) still sell them, probably b/c they have no clue. And really, the likelihood of them being caught at a church craft show are slim. But when you are online, anyone can find you!
I actually quit selling kids items b/c of all the CSPIA crap regarding phtalates etc. I don't want to have to deal with it, so I phased baby/kids stuff out.
Also, selling items made with licensed characters (Dora, Mickey, even NFL, and college sports teams) isn't allowed. Thos organization have the patent on their logo. I can make things with Dora etc, I just can't sell it. Unless I buy a special license from the company...and I doubt those are cheap! There are lots of licensed characters on etsy, but they shouldn't be. At my last craft show, there was alady selling pillowcases. Just pillowcases. Lots of hers were licenses characters too. She make a killing too. Probably not legally though.
