Is it legal for a debt collector to search out a person's relative and start calling them looking for the person that owes $$?
We recieve at least 1 call a day from a collector looking for one of J's parents. We never told his parents our # so we are assuming that the agency just looked up our last name (since it's not that common) and got our # that way. Each time we tell them that the person they are looking for has never lived here and ask them to take our # off their list, but they don't. We try asking for their supervisor but then they hang up on us. They sometimes become hostile and practically yell as us when we won't give them their cell # ( seriously, why would we give a debt collector someone's cell # ?!?!?) What other steps can we take to get them to stop calling us?

Re: Legal question
Are you on your state's no call list? If so, they shouldn't be calling you period. Best place to start there is your Sec. of State's office. Be sure to have the name of the collections company and any other identifying info you can get.
If not, tell them you'll contact your local police department regarding harassment next time they call. File a police report to make an actionable claim.
Stand up for something you believe in.
We actually are on the DNC list. Also, we have threatened to call the cops for them harassing us but it hasn't stopped. I guess we'll just have to take the next step and file a report, then.

They are allowed to call a family memebr, but I believe they are only allowed to call/ make contact once and if you ask them to stop, they have to. If they are just leaving messages, then they can call all day long. If they keep calling remind them they are in violation of the Fair Debt Collection Practices Act. We deal with this with DH's dad... One up them in teh smarts and they tend to stop. Research the FDCPA.
