Parenting classes...whats next?

DH and I have been married for about about a year and a half. He currently has two daughters from a previous marriage. As of right now, we do not have any custody. We are allowed to visit for 2 weeks at a time but with us living in SD and in the military, we cannot afford to travel CA very often to see them. According to his divorce papers, it requires the youngest to be atleast 5 years old and the both of us to attend a child development class before we can apply for summer custody. We are 5 weeks into a 7 week course and now we are wondering what our next course of action would be. I suggested we set up a court date with a judge to discuss this but he says there is paperwork he has to fill out but doesnt know where to get it. He has tried contacting the Department of Child Support Services and they said there was nothing they could do for him since we are living in SD. Any other suggestions?

  • Unless there is a specific reason that he NEEDED parenting classes I wonder if MOM had to take classes too.

     

  • It was just a general request in the divorce decree. There is no specific reason why he needs to take them. It states that both parents have to take parent classes but I highly doubt she has done anything like that since she already has the children and is not fighting to get custody. We are taking the classes to further our knowledge in caring for our children and to also prove to the courts that we are determinded and serious about gaining summer custody.

  • Figure out which court you have to apply to and do that. If each state says yes or no, apply to both anyway, if it's wrong they will deny it. Get proof you are attending the classes, someone should write you a letter if you ask.

    Typically the Dept of Children and Families will work together in different states, it's called an interstate. You may have to contact CA and SD and see what each said. Keep track of who you speak with and who said what. You may need that later.

  • We are taking the classes through social services and they will provide us a certificate for completing the class. I am thinking of seeing the legal office here on base and see what they can provide us.

  • Keep documentation of everything you and everyone you talk to. Contact Social Services in both states but you will most likely be dealing with the CA courts since that is where the children are domiciled (where they live) and those are the courts that will have jurisdiction over the children. You may have to go to CA for an initial court appearance and to explain to the court your circumstances and at that point is when the process of an interstate compact will likely begin.

    Be prepared for a potentially long process and have patience. Also, once you have an attorney if you don't know something ask and if you want something known be sure to tell; full disclosure tends to be the best policy with these kinds of issues. Good luck!
