CA: Why is the death penalty off the table now??

Confused.  I have only tuned in the latter part of last week, and I am confused!

    Where did you hear the DP is off the table?

    Everything I am reading indicates the defense filed a motion for mistrial based on a recent ruling in another FL DP case. My understanding is they want a new trial in which the jury is not death-qualified prior to the guilt/innocence phase of trial, and (I think) a new second jury for the penalty phase if they get to that point.

  • I would be surprised if she got it anyway.  I don't think the State had a strong enough case to support it.
