XP: Working overtime in California question

I can easily ask this question on Monday to my HR person but thought you ladies might know...

I recently moved to SF and started a new job, to my understanding in California you are to be paid OT if working more than 8 hours in a day and/or more than 40 hours a week.

So if our pay periods are Friday-Thursday and I work:

Friday- 10 hours

Saturday- 4 hours

Sunday- 0

Monday- 10 hours

Tuesday- 10 hours

Wednesday- 0

Thursday- 10 hours

So a total of 44 hours... would I get paid 4, 8, or 12 hours overtime??? I hope you can see where I am getting confused about this...

Please let me know if I need to clarify anything! Thanks!

Re: XP: Working overtime in California question

  • I'm not from Cali but my husband just finished working hourly (switched to salaried this week). He would get time and 1/2 for anything over 40 hours. If the same applies to you, you would get paid for 4 hours of overtime.

  • How is a week defined? You worked 44 hours in a 7 day period, but only 14 the first week (Friday & Saturday) and then 30 the second week (Sunday through Thursday). If a week is defined as Sunday through Saturday, you would get 8 hours of overtime.

The "week" is defined Friday-Thursday... so our time cards start on Friday and ends on Thursday (we get paid weekly).

I'm confused because if the requirement for OT pay is anything over 8 hours then I would have accumulated 8 hours of OT. In addition to the 8 hours, I'm also working more than 40 hours by 4 hours.... so 8+4=12. I just don't know if that's right or not.

Anything over 8 hours in a day will be OT but anything over 12 hours in a day will be double time.

Since we get OT pay for anything over 8 hours in a day it is possible to get OT without having to work a full 40 hours in a week.

If you only work 5 days a week with 8 hour shifts you would only get OT if you exceed the 40 hours by working an extra day.

So if our pay periods are Friday-Thursday and I work:

Friday- 10 hours 8 hours of straight pay and 2 hours of OT

Saturday- 4 hours 4 hours of straight pay

    Sunday- 0

Monday- 10 hours 8 hours of straight pay and 2 hours of OT

Tuesday- 10 hours 8 hours of straight pay and 2 hours of OT

    Wednesday- 0

You will have 36 hours of Straight pay and 8 hours of OT

Please let me know if I need to clarify anything! Thanks!

The ONLY way you will not get OT for anything over 8 hrs is if you signed a waiver/consent form with your employer.  You will typically find these waivers used in jobs that are 3/12 or 4/10 for shifts (hosptials, etc)
