ok so here's the deal...in february I was fired for theft from my assistant mgr position....I was accused of stealing a $28 giftcard...even though I didn't steal it, in my file the reasons for termination was "theft of giftcard" It was basically another managers word against my own. I had to pay lawyers fees and the amount of the card back. Even though I didn't do anything I just wanted to pay and put this whole situation behind me b/c i'm very embarassed of it.
I am currently working as a manager of a Mini Golf, but this place is closing soon. I was offered to apply as Customer Service at a bank that I would really like to persue. on the application it says "You must not have been convicted of a felony, or misdemeanor for fraud, defalcation, theft, etc.". I feel so lost in this whole situation!

Many counties put their court records online. I would start there and see if there is anything under your name. If your county does not put records online, it would be worth your time to go to the courthouse and have the clerk's doa search under your name for any records (traffic tickets, divorces, criminal, civil suits, etc.).
If you didn't go to court, very doubtful that you have a criminal case against you. May be one of those times where attorneys talk and came to a settlement outside of court (before it reached that level). Good luck and give us an update when you find out!
Thanks so much for all yall help! Last night I looked at the letters they sent me and it was just a civil suit against me...the second letter stating they got my payment says I am released all statutory civil penalty claims. I was never arrested and the cops were never called. So now I would liketo ask you guys this...I do have one of the associates listed as a reference (I worked very closely with her and she would never give me a bad reference) what do I say when I'm asked if I was fired? I just have been saying that I was terminated due to internal conflict on the management team...is this good enough? Or do I have to go into more detail?? You guys are so helpful!

There actually was alot of internal conflict...a new co manager was brought in and we all started going towards different management styles focusing on different things...I think this opportunity came up for her to get rid of me and she took it...do you think I should just say in interviews that I was accused of stealing a giftcard? if they call the company and they disclose all details they will say that I did take it I don't see saying that I took a gift card going well in an interview.
