What should we do?

Most of you probably already read the post about my friend working for DH so I will not go over it again.  If you did not it is entitled WWYD?-Long.  Anyways.  So this morning my friend filed for umemployment.  She is saying that we laid her off rather than her quitting.  DH is asking me if we should contest it or just leave it be.  What do you think?

  • Your friend sounds like a real piece of work. Of course it's reasons like this that the other girls recommended you get a letter of resignation from her. But I'd 100% fight it, she doesn't deserve it and it really pisses me off when people pull crap like this.

  • I am definitely feeling like she is less of a friend than you thought. She seems like she just keeps taking advantage of the both of you, so I really think that you guys need to stay strong and contest the unemployment. I know when I worked at Bed, Bath, and Beyond if I didn't show up at the time I was scheduled and didn't call in, that was considered my resignation, barring an extremely good excuse such as I was in a car accident on the way to work and ended up in the hospital. Definitely get a letter of resignation from her and save/print copies of the texts/emails she sent you.

  • Isn't what she's doing technically illegal? Filing for unemployment when she hasn't been laid off (and has quit by choice or fired for behavior) seems ridiculous to me.
  • I just got caught up on these posts and I definitely agree that you should contest it.  She had a contract that was about to be up and instead of finishing it out she decided to just quit (and was unprofessional at that!).  She is not entitled to unemployment benefits or a positive recommendation for any potential employers IMO.  Sorry that you are going through all this drama!

  • Not sure about other states, but in La, I had to submit a letter from my employer to the UE office stating that I had been laid off in order for them to process my claims.  She quit.  End of story.  Even if you would have let her go- there is a difference between being fired and being laid off.

    Right?? Don't let her drag you into legally murky waters that could potentially get your business in trouble.  She quit.  End of story.

  • I agree with what everyone else has said.  She's obviously not a good friend, and I wouldn't worry about pissing her off.  Like everyone else said, don't get your business in trouble just to "help" her.

  • After all the crap she put you guys through, and now this, I'd contest it and leave the friendship in the dust where it belongs. I can't believe the nerve of some people. Sorry it wound up this way.
  • i absolutely agree with the majority, you should fight it.

    but it does make my heart for you guys having to do this to someone you at least consider a friend.  that is a tough and sticky situation.

     I was going to ask this same thing. It might be smart to have a lawyer involved. Id hate for this to get turned around and you guys come out looking in the wrong or something, when you're clearly not.

  • Contest it contest it contest it...you will win.

    She quit...end of story.  She abandoned her job without any notice, there's no way that UE will rule in her favor.  Not showing up to work when she is scheduled without giving you official notice is misconduct.

    And I say screw the friendship...she's obviously not a friend.
