pumping at work ?

I went back to work on Wed.

I spoke with HR before returning about what their policies were on moms who need time to pump.

HR referred me to my supervisor.  My supervisor didnt' have a clue on how they could give me more than my allotted 15 minute break for pumping.  (I don't know about you, but my boobs aren't that efficient).

Anyway, I was curious to know if there are any laws (or the similar) that allow moms the time to pump without being penalized while at work.

This might be a stretch, but I thought I would ask.

Thanks!

Re: pumping at work ?

  • Here you go!  Also, I pump in my office so I can work and pump at the same time.  I pump around 10 or 11 and then about 2 every day.

President Obama signed the Patient Protection and Affordable Care Act, H.R. 3590, on March 23 and the Reconciliation Act of 2010, H.R. 4872, on March 30, 2010. (See the combined full text of Public Laws 111-148 and 111-152 here.)  Among many provisions, Section 4207 of the law amends the Fair Labor Standards Act (FLSA) of 1938 (29 U.S. Code 207) to require an employer to provide reasonable break time for an employee to express breast milk for her nursing child for one year after the child's birth each time such employee has need to express milk. The employer is not required to compensate an employee receiving reasonable break time for any work time spent for such purpose. The employer must also provide a place, other than a bathroom, for the employee to express breast milk.  If these requirements impose undue hardship, an employer that employs fewer than 50 employees is not subject to these requirements. The federal requirements shall not preempt a state law that provides greater protections to employees.

  • I obviously don't have an office (I don't even have a closed off classroom -- open concept)... so what I do is take my lunch to pump (@11:30 - 30 minutes), and I got permission from my principal to be 5-10 minutes late meeting my kids for recess. Some days, I get done on time, but not usually because I have to get a key from the secretary and go to one of 3 rooms. Then, I take my last 30 minutes of plan time to pump -- I take stuff to work on so that I'm not losing that time since I don't have enough plan time as it is!

The biggest pump time for me, though, is driving. B usually eats around 5:30 or 6:00 -- I can't go until 11:30 without pumping! So, I got a hands free bra and a car adapter and pump on my way to work. It's perfect! And now that he's settling into a routine, I know that he won't usually eat until 6:30 or 7:00, so I pump on the way to pick him up. (I tried pumping at home, but I feel like that's taking time away from him, so I just pump in the car again)

I would say if they "really" can't give you the extra time, offer to go off the clock, and take the time you need - can you go in early or stay late to make that extra time up? Some employers are better than others, but legally, they ARE required to give you that time!

  • The key here is, does your company have more than 50 employees?

If yes, you have rights.  If not, you don't.
