Another Landlord issue Help!

HiMy DH and I deposit our rent check each month into our landlords wells fargo account. I always write on the back for deposit only and her account number. Never been an issue. We get a receipt from the teller. FF to today: My husband gets a call from our landlord saying we have not paid our October rent. She was quite rude. He tells her he did it himself on Sept 30 and has a receipt. She tells him he has to give her the last 4 printed on receipt. He texts me asking me to look. I did and I checked our bank account the check cleared on the 4th. He tells her the info requested. She calls him a liar. Then tells him HE MUST fax her the receipt. We do not have a fax and would have to pay to do this and he is at work til 9:30 tonight and I do not have a car. I texted her all the info from the receipt. She told me she can evict us for this and I NEEDED to fax it to her NOW.I do not feel this is my problem. I see the cleared check with her account number and have given her the info from the teller receipt. I also do not feel I should be out money to fax her anything.I originally wanted to send her the rent money each month and she refused saying it had to be deposited into her account.I think I would feel differently if she was nice and a good landlord, but she is not. Anytime we have had a maintenance issue she drags her feet and says she will get to it when she feels like it.Am I wrong to refuse to pay to fax her the receipt? Also am I wrong for feeling this is not an emergency to me?Thanks

  • Hello, as painful as it is, you MUST give her a copy of the receipt.  Then she will be unable to argue with you.

    I work in the accounts department of a property management office, and even if I can see the deposit in our account, and the person says it is theirs , if it has no reference number with it then I will NOT apply it to the tenants rental ledger until they have provided me with a copy of the receipt.

  • I would just give her the receipt.  I also work in Property Management.  She cannot evict you based on non payment if in fact you did pay your rent. So you could choose to ignore her, let her go through the process of eviction.. i.e. send you a pay or quit letter, wait the proper amount of time, and then file in the court system.  You could show up in court and show the receipt to the Judge and then she would be out the lawyers/court costs and alot of time and anguish, but you would also be out alot of time and anguish.  So... my advice to you is to just show her the receipt and keep them handy in the future when she has her mini freak outs.   You are correct that this is not an emergency and can wait.  She cannot immediately start the eviction process...in fact there are state laws in place that dictate written notifications called pay or quits. If you show her the receipt on Monday there will be no harm lost.  Sorry she is not a good landlord.  I have always worked for large reputable companies and I currently work on a Military Installation renting to families.  I often see how private owners off post mistreat the Service Members...

  • That stinks!  You just don't seem to have luck with landlords.

    I would just get her the copy of the receipt.  It will save you a whole lot of headache in the long run if you just give it to her; then she can't argue that you paid it.

    I scanned the receipt and emailed it to her. She lives out of state so I couldn't just give or show it to her. She is still being a Witch and saying I must have screwed up. I pretty much told her I paid, I gave her the receipt and I even gave her a print out of the check from my bank showing it was paid to wells fargo with her account number on it. It is her problem. I told her I will do nothing more for her in regards to this.

  • Did she call you back to apologize? That's really effed up. Obviously, you are not living in NYC or five boroughs. Over here, if the check cleared, no renter would even pick up a phone... hell, I wouldn't! I would have told her that I can see the check has been cleared and I welcome her call after she checks her own facts. But, like I said, in NY landlord is always a loser... tough but true.

    So, what did she do after you sent it to her?
