It all started when I resigned from my last job in March. My final paycheck was withheld b/c supposedly I took too much vacation time, as I did not stay until the end of the year. (I now know that was an ILLEGAL move) Nowhere in my contract was vacation described as pro-rated or earned based upon time worked.
Three months later I received a letter from a debt collector out of nowhere that I owe another $1700! My work place sold my debt without ever contacting me. I wrote a letter asking for an explanation of alleged debt (my right under law) only to get a letter back without any enclosure, although it referred to an enclosure explaining the debt. Another request was sent.
Tonight I get a phone call that I am being summoned AKA SUED! I cannot believe this!
Has anyone here ever been sued? Please tell me there was a good outcome!

I can't believe your employer sent your case to collections without even giving you a chance to pay. That's crap. I guess you should contact a lawyer? Is it small claims court? If you want to avoid this whole thing and pay them I'm sure you can contact thier lawyer and make some kind of arraingement.
I'm not understanding how they can sue you if it's nowhere in writing that vacation time is accrued as you go. That's not okay. MH's previous job did this but it was addressed in the employee handbook that he was given during his new employee orientation. I'm not certain that is an illegal practice but it sounds like you may have to seek legal help if you haven't already. How vacation benefits are handled varies from state to state. I hope this works itself out in your favor, sounds like it should!
