Based on other news articles, his defense team's argument is that he shouldn't have been given access to classified information because he struggled with gender identity. http://www.bbc.co.uk/news/world-us-canada-16232455  A few excerpts from this BBC article:

"The soldier had also reportedly assaulted a superior, turned over a table, damaged a computer and on another occasion was found "curled up in a ball".  (They're saying his classified access should have been revoked at that point.  I disagree, but I sure as hell hope they add those charges when/if this goes to trial.

"His defence team is also expected to argue that little harm came of the leaks, and that their release was in the greater public interest."  This sounds like they're grasping at straws.  It doesn't take a genius to comprehend that it doesn't matter what it is, you don't post classified on the freaking internet or give it to the adversary.

  • If it is true that he's had a history of instability I think his clearance should have been revoked.  With that said, just because it wasn't doesn't exempt him from his responsibilities under that clearance.

    I really believe he was trying to make a name for himself.  I don't think he cared one bit whether this was in the better interest of the public or not.  I'd be curious to see if Julian Assange(sp?) encouraged him to continue sending information by promising him fame or money.

  • I could write a dissertation on the misuse of GID as a defense here. It's not something that makes someone unstable or committee espionage. It really pisses me off. I just.... SMH. Ug. So many misconceptions here.

    Ditto, ditto, ditto.  Struggling with gender identity does not mean that you're mentally unstable.  I've stopped reading the stories because they only make me mad.
