No Breaks @ Full time job?

I work a timeshares department in marketing and hospitality, a high stress job, meant for 3 people to work, but we only have 2 people including myself. First girl got in a car accident and left work and never returned, second girl we hired was terrible and transferred to a different department. Now, they won't hire anyone else. They expect me to work this entire department by myself, pitch every sale that comes to my room, and be an anger management counselor to the owners who just spent a crapload of money just to be sitting in my office for 1+hour, and they won't give me a pay raise and are giving me extra reports and responsibilities to do. We have no other management team working with me, my boss is in Florida.

My hours are open to close. But close is NEVER consistant. It's whenever the last salesperson leaves {salesfloor is 19floors up, they never answer their phones, and never give me a courtesy call to tell me they're finished} So I'm usually here from 9:30-7:30. I then stay half an hour later to distribute nightly reports to everyone.

My boss got upset for me getting overtime, so I try to come in at 11am instead but I end up missing some sales that come into my office, and then sales management get upset for me not being there. If I'm not there, they fear that their deal could go sour because the buyers have to wait so long ~ I'm usually there to calm them down and keep them occupied until contracts are ready.

No breaks, no lunch. I've talked to my boss about this and she says to try to sneak it. But it sucks having to gulp your lunch down as fast as possibly, only to have a sales agent bring in another set of owners while you have your face stuffed. It's so annoying. And I hardley ever find a time to "sneak" food when my room is constantly filled with buyers. Isn't there some kind of labor law aganist this? There must be.

I've been here a year and a half, and when I first started, I liked it, but now I'm really thinking about quitting and finding a new job.

  • That sounds absolutely miserable. You need to sit down with your supervisor or manager and tell them if x-y-z doesn't change within the month, you will have no choice but to resign. If they want you bad enough, they will hopefully be responsive to your requests. 

    There are laws about letting employees take breaks. They are required to provide breaks proportionate with hours worked, and it's your choice whether to take them.

    This isn't true in my state. The employer is responsible for making sure the employee takes their break. There are large fines they could face from having an employee not follow break and lunch laws even if the employee refuses to take a break. I've actually heard of people written up for not taking a lunch. I would look at your state law.

    The exception in my state is if you are a salaried employee. I actually prefer being salaried because you don't have to take a long lunch and get to leave the office early, but only in normal work environments, not what you are describing.

    However, I was working in CT and we had an office of less than 5 people, and we were pretty much told that because there were so few of us, breaks had to be taken when we could - pretty much like your boss has told you. There were days that there would be only 1 of us in the office, and you had to figure out when to eat, use the restroom, etc. I don't know if its law or anything, but I want to say that if its less than "x" amount of employees, breaks are when you can. (I could be VERY wrong. But I remember equating it to FMLA where you have to have so many employees for it.)

    This.  Your work environment could be seen as "hostile".  I would have no problem telling the company that either.  Hostile work environment lawsuits will cost the company major money and they can get shut down if they company isn't careful.

    I worked for a hospital that ran the exact same way as your company.  The hospital couldn't understand why the turn over rate was so high and why people were leaving right and left for better job opportunities.  Good luck.  If I were you, I'd start looking for a different job.

  • You can review the laws for your state. But I think you are much better off just looking for a new position.

  • Thanks everyone for your input,
    I'm tired of all the changes this company has made, and I honestly can't stand the new sales management and new team members.

    I'm going to start looking for another job. I'm tired of playing their games, and being taken advantage of.
