At first I was prepared to be outraged and think that mom should be locked up for child abuse....then I found out it was in honor of his brother that died. In my mind eye I had this image of these horrible people thinking it was funny to take their kid for ink, but in a way its really kind of sweet and it isnt like he will regret having his brother's name on him. I do think the shop is liable for doing it in the first place.

I am pretty liberable when it comes to things like this and I am really appalled by this. My son is 10 and I would laugh in his face if this was even a question now. I have a few and once we get to that point I would have no problem saying yes, but not at this age!
The shop and artist should definately be held liable and lose their license.
