HOA Invoices ?

I just received our HOA invoice.   Besides the fee being $70 more than we were told when we bought the house they sent the invoices out 15 DAYS before the fees were due.   The letter is dated January 16th and they are saying the invoice is due February 1st or it will be late and accrue fees. 

Is that even legal?   

I'm PO'd because they mailed it to our previous address so I just got it today only giving me 10 days to pay it.   I have no idea why they have our old address to begin with.   I've never seen invoices sent so late with the due date so soon.  

Does this happen to anyone else?

  • I doubt there is much you can do. Did you get a copy of the deed restrictions or covenants when you bought your house? It probably has the fee schedule in there. Our dues are due at the same time every year, so even if I didn't get the letter very far in advance, it wouldn't be a surprise. It is a big chuck of change, so it is never a pleasant check to write (especially RIGHT after Christmas -geez!), but it is something we knew about when buying in a development with an HOA. Have you called or emailed to ask about doing partial payments on a payment plan? Our HOA does this for people who can't pay it all at one time. GL!

    No we didn't get a copy of that.  Partly my fault but partly the fault of the crappy sales lady.   We were supposed to get that from the sales lady when she gave us our keys after closing and she never gave it to us but I never went back up there to push for it either.  

    I emailed them today to complain about them sending it to the wrong address and the small amount of time to pay.   With everything going on the last 2 months, HOA dues were no where on my radar.  lol

  • Ours were mailed out early-mid December and due by January 31. But no, there's nothing illegal about getting the bill 15 days before it is due. Even if you never received a bill, it would still be due at the same time and you will still be liable for any late fees accrued if you didn't pay it on time.

    I'd ask about the difference in what you were told and what the bill is - but they might have put their fees up this year and $70 less is what the bill was last year.

  • We got ours within a 30 day notice but we knew when it was due.  It was in our deed restrictions and HOA fees are usually due at the start of the year so we knew it was coming.

    This is the same as ours.

  • We still have not received ours and they are due February 1. We know this cause we called the HOA. We sent our check about two weeks ago and it has not been cashed yet. DH is going to call on Monday to make sure the check was received.

    I'm pretty sure we got ours at the beginning of December.  They are due on the 1st of the year and late after the 31st.

  • in the past we'd get ours in mid to late december with the full amount due on jan 1. we always knew it was coming though so we'd planned for it.

    this year we have a new company and they changed it on us and didn't send an invoice until the second week of january. its now due in 2 installments and the first is mid february.

  • They emailed me back yesterday and said that they had mailed invoices in October.  So either they didn't mail us one then or because they mailed it to our old address the invoice got lost. 

    I still don't understand why you send mail to a previous address instead of to the address that is in the neighborhood...

    As far as the fee goes, they said that basically the fee goes up every year and it hadn't been $300 since 2008!   Not surprising considering all the lies from the sales person in the neighborhood.
