State to file for child support post-divorce? Plus owed expenses
Our divorce agreement did not provide for any child support as we were to share custody 50/50. Well now I have 100% custody pretty much (my son might spend the summer with his dad). I want to file for child support but I don't live in the state where we got divorced any more (I'm like 1000 miles from it). Can I file in the state I live in now? My XH lives in another state (not where we were divorced either). Also, he owes me for half of my son's summer camp from last year and half of is after school care - totaling about $2200 and he won't pay me. Is there anything I can do to get him to pay me? And if I am awarded child support, is there a way to get him to pay me other than garnishing wages? (he hasn't worked in 3 years)
Re: State to file for child support post-divorce? Plus owed expenses
We're kind of going out.
Agreed.
In which state?
It can vary by state but I think for the most part if the child has live in the current state you're living in for x amount of months you can file for support in that state. XH went through this with his first wife. She had moved to NV where her parents lived and because he had lived there for more than a specified number of months, she was able to file.
Where you currently reside. A lawyer will either tell you to get one in another state or what they can do for you.
