The 9th circuit has held Prop 8 unconstitutional. The case could end up in the Supreme Court but we'll see. At the end of the day, however it happens, I will be glad when Prop 8 goes away, but I remain saddened that a majority of California voters were in favor of it.

Re: Yay 9th circuit!
I was just on-line looking for a summary.
I wish I had more faith in the SCOTUS, especially with respect to the 9th Circuit.

Snuggle up, I'm on your couch too.

Agreed. On the one hand I would love them to rule on it, but I do think waiting will probably lead to a better result. Is there any indication of how Brayer would vote?

The Supremes have to rule based on the lower courts' findings, right?
If this is the opinion:
Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples.
How are they going to manage to find that this 1) isn't true or
that making laws solely to demean the status of a minority is okay-dokey under the constitution?
Not that the hardliners couldn't find a way, I just don't know HOW they can without perverting most of what freedom in this country means. If they go for the "gays have the same rights to marry the opposite sex as anyone else so they aren't demeaned" I swear my head explode so loud they'll be able to hear it in DC.
My favorite blog response:
It?s even good news for Prop 8 supporters, who are fuming and raving in response to the decision. But don?t worry too much about them ? they enjoyfuming and raving. It?s kind of their hobby. This ruling neither picks their pocket nor breaks their leg. It doesn?t harm or inconvenience them in the least. But today?s ruling provides them another excuse to pretend they?re put-upon and persecuted, so right now they?re as close to being happy as they?re still capable of being."The meek shall inherit the earth" isn't about children. It's about deer. We're all going to get messed the fuckup by a bunch of cloned super-deer.- samfish2bcrab
Sometimes I wonder if scientists have never seen a sci-fi movie before. "Oh yes, let's create a super species of deer. NOTHING COULD POSSIBLY GO WRONG." I wonder if State Farm offers a Zombie Deer Attack policy. -CaliopeSpidrman
