Do any of you have experience with breaking a lease? although we were supposed to be here for 3 years, we just got orders to a new duty station and movers are coming in 2 weeks. Feb rent has been paid and lease goes until July 30th. Under SCRA, it looks like its next month + 30 days - so is march rent still due?
Re: Breaking a lease
You have to give written notice with a copy of the orders and you will be released '30 days from the date of the next rent payment due". If you supply those two things, you will be able to leave your lease anywhere in the US with no additional penalty under SCRA.
So yeah, it's February 10th and your next pay date is March 1st - you'll probably have to pay March rent. Sorry!!!! Legally that's what you've got, unless your lease has some other provisions. Try talking to them and appeal to their goodwill?
ETA: Here's the deets: CLICKY
30 days from the day you give them orders and written notice you're vacating. Sometimes your lease will have a specific military clause that will be less.
Just talk to them and usually they're more than willing to help out.
ETA: Definitely look into your lease to see if there is a military clause. All of our leases have had it and it made it exactly 30 days (or however long you state, but no less than 30 days) from the day you give written notice. So if we gave written notice tomorrow we'd pay 11 days of prorated rent.
