NJ FLI and Employer's Short-Term Disability Help

Hi.  I had a quick question (about maternity leave) and I'm hoping to get some help.  I work in NJ, but my company is based on CO.  My HR Rep. told me I do qualify for NJ FLI (it's taken out of my paycheck), and she believes I can use it at the same time as the company's STD (she's not sure though and wasn't aware of it until I had asked).

So, my plan is to work up until the baby is born.  At that point, I understand I have to use a week of my PTO before the company's STD will kick in.  My doctor said assuming no complications, he'll sign off on STD for 6 weeks after vaginal birth.   If I give my company at least 30 days notice before the due date, can I receive the NJ FLI benefit at the same time as the STD, or will that benefit be reduced because of STD? 

Is there something else I might be missing?

  • STD and NJFLI can NOT be used at the same time.  You send in your paperwork for NJFLI as soon as you STD ends.  You can't send it in before or it will get delayed or denied.  All the other info you put down is pretty much spot on.

  • STD and NJFLI cannot be paid out during the same period.  You would collect STD and once you are no longer disabled, you can collect NJFLI.

  • Thanks!  I had a feeling that was the case, but my HR rep (again from CO and not familiar with it) thought otherwise.
