Mold liability release

If a listing has a note that says buyer/agent must sign mold liability releasebefore entering the home, am I right to assume that mold has already been found in the home? I'm hoping it's just a precaution because the listing is excellent. I do believe it's a foreclosure. Thanks!

  • I think it's possible that they currently have or in the past had a problem and are just trying to cover themselves.  With this info, if I was to move forward with putting in an offer it would most definitely be contingent on a mold inspection.  The seller's agent might also be able to tell you why they specifically are asking for the mold liability release.  I personally wouldn't walk away because of this.
  • I think the rules on this will vary by state.  I did know the rules for my state, but if you had a certain amount of mold and remediated it, you had x years where you would have to disclose it when you sell. 

    I would assume that there is either active mold or recently remediated mold in the house.  If you are seriously interested, please make sure you call an independent mold inspector to test and ask the sellers for the company who remediated the mold.

    Mold is one of those things you don't want to mess around with and needs to be handled professionally as it can regrow, could be behind drywall, in studs, in insulation, in ductwork, etc.

  • Thanks for the advice! Spoke with the agent and found out that there is active mold in the interior walls. It is a foreclosure so sold as-is. Not something we want to take on!
