Bump C&P: filing bankruptcy over speeding tickets

I'm not one to judge someone for filing bankruptcy but I can't get over how she seems to think her H's behavior is no big deal.

    I don't think criminal fines are dischargeable in BK, but I'm not a BK attorney.  In the event they are NOT dischargeable, I hope she does declare BK, because that would be its own special kind of justice.

     

    I don't think they're criminal fines - I got the impression that they're the cost of fees associated with impounding the vehicle for the last 18 months.

  • I don't know if they are married.  So who is filing bk? The guy?  And he moved from ME to VA (per her bio) away from his two other kids?  That is pretty douchey.  And I love these drama stories.  My soap went off the air, so this is sort of the same thing.

  • On second thought, why would they have to give up their living room set? I've heard of cars being repossessed, but living room sets? And if they're garnishing his wages, why is their living room set in danger? I'm really confused now that I'm rereading.

    I call bulllshittt on this:

    Well fast forward to 2 weeks ago, we get  a letter in the mail; we must appear in court to pay the now 11,000 something we now owe because the bank never went to go get the truck, and never sent us anything about it, or contacted us to tell us they weren't going to get it. So now they are garnishing DH's wages for $519 a month. which means we would have to give up our SUV and our entire living room set, and choose between tv or internet to afford that payment.

     

    They were probably mailing letters and calling for months and months and months.

  • Why does one have to speed in order to show off their "sweet" truck? Wouldn't slow rolling through the neighborhood give one more opportunities to be a gloating douche?

    Also, depending on their definition of "sweet" I'm hard pressed to believe it's the speeding tickets and not the truck itself that is a huge contributor to the bankruptcy.

    My guess would be they are doing the lease or rent to own deal on the furniture... so they wouldn't be able to make that monthly payment, the monthly payment on the SUV, the monthly payment on the internet or cable. yada yada yada

  • I'm a pro bono bk attorney and I don't even know that they'll get this dismissed.  This seems like a whole lot of idiocy and no actual hardship.  They let the car get repossessed but then didn't follow through with the bank?  What? He liked to show off his sweet ride?

    Also, I'm pretty sure it takes longer than 2 weeks to start garnishing someone's wages. There's no way they didn't know anything about this before 2 weeks ago.  What did they think happened to the truck? Were they making payments on it or did they think it and the loan on it just disappeared?

    ETA:  Also, bet you anything he never got a new license when he moved so all the paperwork was going to the old address.  My CW just realized yesterday that her license was expired, and got all righteous because they 'didn't send her anything'.

  • If the truck has been seized by the state for use in the commission of a felony, can the bank even go and reclaim it?  I don't think they can. I think the state can just sell it of.

     I think he told the bank he wasn't going to pay anymore and to *** themselves.  Then told her he took care of it.  Then went and got himself an SUV.

    But even when the bank repo's your car, you still have to settle your loan (I doubt the truck was worth more than the outstanding balance). Did they think it just disappeared? 

    I am with ESF - I think the husband (boyfriend?) lied to her and has been hiding it for who knows how long.

    It's not clear but I thought the $11k is for them not paying the bank for the truck.

    But now that I think about it, if the truck was really that sweet, they must have owed more than $11k on it. 

    I'm sure she doesn't even know or understand.

  • No, they thought the bank had the truck.  The bank does not have the truck.  The truck is still in impound and there is an additional $11k now due to the state.

    OK yes, this is probably it.  Maybe the bank did repo it, but since he was upside down $11k, that's what they went to collect.

    They can sell it at an auction. DH has seen people come and buy back their own property.

  • I've only just started reading but my impression is the 11k is owed to the bank for the truck -I think they just stopped making their payments and it probably includes interest etc etc.  And in response to whoever said the 11k probably isn't for the truck if it is "sweet" - in my experience if someone has to describe their vehicle as sweet, it probably really isn't.
