Lurker with a Supreme Court Justice ?

Why does Justice Thomas never ask questions?  In an article I was reading about the health care debate before the Supreme Court it said Thomas last asked a question 6 years ago?!

Does he just not prepare and get ready for cases so he doesn't have questions?  Isn't that what his clerks are for...to help him look prepared and get answers to help him decide?  Anyone have any insight as to why he does this?

  • There was a great article about this.  I think he thinks its disrespectful for those arguing in front of him since that get limited time, I also think he is always very well prepared for cases.

  • He doesn't ask them because he believes that oral arguments are a bit of a charade, says he has nearly always made up his mind before the happen, and thinks that the firing away of questions is disrespectful to the lawyers who are trying to make their arguments.

    I'm a huge Thomas critic, but this habit of his does not bother me, nor do I think it suggests that he is stupid.

  • No, it's not that he's not prepared.  He simply doesn't think that questions generally further illuminate the issues.  He believes that the briefs and the attorney's statements are generally sufficient.

    Also worth noting is that since Thomas joined the Court, it's become more vocal.  When he joined, far fewer questions were asked than are now.  Given that, I wouldn't be surprised if he finds that the few questions he does have are asked by his fellow Justices.

    True.  It's his written opinions, or should I say concurrences and dissents that paint the picture of his stupidity.

    Not sure how that would be you assumption. I recall something about he does not like to interrupt but I could be off.

    Should you be here right now Justice? With arguments going on and what not, shouldn't you be taking notes and listening. Or are you going to get Cliff Notes from Justice Scalia?

  • I was very influenced by the treatment of Clarence Thomas.  He was one catalyst for my move from liberalism to conservatism.  Of course his lack of questioning doesn't mean that he is unprepared, and the canard that he takes his lead from Scalia is unfounded.

    He should be impeached for not recusing himself from sitting on the bench for the ACA appeal. His wife is just a little too close to you guys.
