Divorce papers question

How long did it take for your divorce to be official once divorce papers were sent to the judge for him/her to sign?

  • I'm guessing this varies from State to State.  In Wisconsin, there is a 120 day waiting period from submitting the paperwork to the clerk of courts and the day you sit in front of the judge to confirm the paperwork is correct.  So on that day, the judge signs off and you're divorced that day.

    ETA: I had my signed papers that day

  • We've already saw the judge back in January and everything was recorded then and made official. This is the written version. I signed, X signed, both our lawyers signed, the judge just has to sign too. We won't have to go back to court.

  • Interesting! Here in WA I had to file the papers, wait 90 days, get a court date, which was another like two weeks after the 90 days, and at that date since all was agreed upon the judge signed. i just had to wait for paperwork to be processed, and then I had to pay to get a copy of the divorce decree.
  • Maybe 5 days? There's a waiting period here but when we had everything worked out we were already past that waiting period.
  • I learned a hard lesson- judges take breaks during the summer months, and any civil matters not involving child custody get put on the very back burner. We submitted them in late June and the judge did not look at them until September, when he denied them and sent them back to us. We resubmitted the first week of October and got them back 2 weeks later. There is no official waiting period, they were busy and operating on a skeleton crew.

  • Ok thanks. To be clear, this is the final divorce decree. The whole process started in June of last year and we saw the judge twice. We settled on everything back in January and had it recorded on "tape" before the judge (this is a whole new geeky thing to save money as it's cheaper than a person typing everything). 

    My lawyer drafted the whole divorce decree to have a paper copy and we all signed except the judge. The papers were sent to the judge a week ago. 

    I guess I should expect something in my mailbox in the next couple weeks saying "yeah, you're finally divorced!".
