pre-possession?

Has anyone done a pre-possession agreement when buying a house? Our sellers have sucked and it's has taken almost 4 months to wrap this up. At this point we have to be out of our rental on May 20th and there is stuff that needs to be done to the house before we can move in (due to my pregnancy). So we are considering asking for a pre-possession agreement to be able to get in and do work now and then occupy the house starting May 20th.

 Has anyone gone through this? Any advice?

  • I would be very leery to do this especially in light of crappy sellers.  What if for some reason the sale doesn't go through?  You have sunk time and money into a house you do not own.  Just something to think about.  There are a lot of reason closings don't happen, I am just not sure it is worth the risk.  If you were just wanting to move it sounds like a great idea, but I would not start on any projects until you actually own the house.

  • I understand...I'm just at a loss of what do. We have no where to go after May 20th...there is no such thing as month to month rentals in our area.
  • Are there any extended stay hotels in your area that could work for temporary housing? You could always put most of your stuff in storage and hang in a hotel for a week or two while you do immediate repairs to the house.

    Like the PP, I would be leery of doing work on a house that I do not own in a situation involving difficult sellers.

    If the house is vacant, you could ask for a rental agreement until closing.
  • Yes, if it's vacant ask to rent until closing but don't do any high cost projects until you close - too risky. What if you fix up the house and make it really nice and the sellers decide to back out...

    When I sold my house my attorney told me under no terms should I allow them in till after the closing.  The house was empty for 3 months before the closing and it stayed that way.
