Life insurance on your ex?

So, the friend I was helping to find an attorney just told me that her spouse, she's already filed for divorce, told her he wants a life insurance policy on her as part of their terms of divorce!  Ok -- so my ex has a life insurance policy, as do I, because of our kids.  They don't have kids so the only reason why I think he wants a policy now is because he plans on collecting on it when she dies in 60+ years or plans on putting a hit out on him!  Is this guy crazy and off his rocker or am I not seeing something?!

    The only reason he needs life insurance for her is if they had kids together or a joint property / business. 

    He can "want" all day long.  Wanting isn't getting.

    However, I believe that he can still take our a policy on her (without her consent), but she doesn't have to take a physical or anything if that is required for the policy.

  • In my state it's required by law to have a LI policy for at least the parent paying child support (possibly both parents though), the idea being that in the event of the parent's death, the child would still be provided for via the policy.

     

    ETA: Nevermind, I just read that they don't have children. In that case, I ditto the previous poster who said he can take one out himself, but he can't force her to get one. And honestly if she fears for her safety then she should report his actions to her attorney and potentially the police.

  • If my STBX did that I would assume he had plans to kill me. I would not agree to this.

    I highly doubt he wants to whack her. 

    More than likely he is probably asking for the sky and hoping to re-coup some his losses down the road when she does pass - naturally.

    He can ask for whatever he wants - doesn't mean he'll get it.

    All she simply has to do i say she does not agree with it, and if he insists on it in court, she should rest easy that that no judge in their right mind would grant a childless spouse that request.  

  • Thanks for all the comments, Ladies!  I knew he had to be crazy! He hasn't said much more about the LI policy so hopefully he realized that wasn't going to happen.

     

  • If they have children together or if one spouse is required to pay alimony or spousal maintenance then yes, they can and will most likely get a life insurance policy.
