Paid a fence company 6wks ago and still we have no fence...help!

6 weeks ago we paid a fence company $1800, partial payment, to install a fence. At that time he said he had one job before us and should be back in 1.5 to 2 weeks to get started. 2 weeks went by and still nothing, not even a call to update us so I called him and he said he had some delays and it would be about 1.5 weeks. We gave him another 2.5 weeks and called again and he gave some more lame @ss excuse, job was taking too long, whatever, said he would be ready the end of last week. Guess what? Still nothing. Is this typical behavior? Im thinking we give him until Wednedsay and if nothing happens demand our money back. WWYD?

  • Demand your money now.  Keep a log of everything.  Be prepared to report him to the BBB and your state consumer complaint division.
  •  I had a contractor once who also took partial payment and wouldn't finish the job unless I paid in full. He wanted the money because it was the end of the month. Which I can care less about. He threatened ME to take me to a court for not paying! LOL! Which was the route I was going anyway. I was going to tell him that we had a contract and he will not get paid unless he finished the job. He sat on his bluff for 2 days and then came back grudgingly to finish his work.

    Do you have any documents that he signed that shows the estimated date of completion? Document everything. Take notes when you talk to him. Ask for money back of course since he has failed to do the job. He needs to pay you back. I don't know why he even took the job if he is so busy!

    What does it say IN YOUR CONTRACT about payments and date of completion?

    Or are you guilty of not having anything about payments and completion dates specified in your contract? Or worse, no contract at all?

    I'd call him and tell him that he has one week to complete the job or give you a full refund, OR ELSE you will sue him in small claims court. And if he doesn't meet this deadline, follow through and sue him. It's not a big deal and totally worth it.

  • I understand some thing come up that delay projects a few days, but 6 weeks is ridiculous. I would get my money back now and go with someone else.
  • Most companies don't require pymt until work is in progress, and typically completed.  I would call him every hour until someone returns my calls.  $1800 is  a lot of money, and for 6 weeks to go by, I'd be pretty nervous I wouldn't get my money back or the job done.
