I heard on the radio this year that the No on 8 people already have attorneys working on the issue of how this will work in our Consitution, becuase basically it will create a contridiction. One part of the constitution will give gays rights and another take it away. I am not holding my breath that it means anything, but you never know.
Also, what about the couples that were married? From what I understand the language in the amendment wasnt very specific and I beileve the AG said that he thought the yes on 8 folks to go to court to fight to have the marriages performed overturned.
So in 2 years, are we going to be able to put a prop on the ballot to remove the prop 8 language from the constitution?

I still can't believe it passed. It's disgusting. I just don't know what to say to my gay friends...there are no Hallmark cards for "sorry your civil rights got taken away."
This is a big ass mess. Jerry Brown was on the news this morning saying that they will do whatever is in their power to make sure the marriages already performed remain legal. So we'd have some couples that are legally married and others that are denied the same right. Suck a clusterf*ck.
If, in 2yrs, we've got a prop on the ballot to repeal 8, I vow to volunteer my knitting time to promoting the cause. I'm really upset right now.

My guess is that this is likely something that will land gay marriage in the Supreme Court.?
If there's a legal challenge to an amendment, don't they have to wait until the challenge is decided before implementing it? ?So, since gay marriage is legal, wouldn't it have to stay legal until the final decision? ?I don't think that's been the situation in any states that passed anti-gay marriage measures before.?

Legally speaking, new laws rarely are applied retroactively because there is the issue of notice, or more precisely for purposes of this matter, lack thereof. Moreover, in this case, I am unaware of any specific language in the amendment that retroactively nullifies gay marriages. Absent such language, I am not sure what the legal basis for nullifcation would be.
