Sellers pushing closing date back

We had a tentative closing date set for August 7. We heard today that they "cannot get their furniture out of the house until the 9" and our attorney is off and cannot close on August 10, which pushes our closing to August 13, the date that our mortgage is set to expire.

We've been in a 90-day closing at the sellers insistence, despite the fact that this has led us to be homeless for a week as our lease is up July 31. At this point, I'm fed up and ready to look to see what else is available. In my mind if we have to reapply for our mortgage, we might as well see if there's anything out there that's better and that has sellers who actually want to sell their house.

All of the paperwork everyone signed (back at the beginning of May) listed the tentative closing date as August 7. Does anyone know if what they've done would invalidate our contract and we would be able to get our deposit back? Any advice to offer? We're pretty upset right now.

We had the sellers push the moving date back by 2 days. We still did all our side of the paperwork on the agreed upon closing date, and then our agent faxed it all to thier agent and they signed everything adding the clause that possesion would not take place until the 2 days later, and we just had to initial that we agreed to the changes. Didn't change anything in the morgage or paperwork otherwise at all so I don't really know why you would have to re-apply for morages unless you as the buyer decide that you cant wait another 2 days and refuse to sign the changes. (But no it does not invalidate anything unless you as the buyer refuse the changes, so you can get out if you want to, but in the grand scheme of things if you like the house I don;t know why 2 days is a big deal)

Our mortgage was approved for 90 days. The last date that it is "good for" before we would have to reapply for it (losing the rate we locked, having our credit pulled again, basically everything that goes with having to apply for the mortgage in the first place) is the date that the sellers now want to close. If they push things back again, I'm afraid that we'll have to reapply, further delaying the purchase by weeks as we wait to hear that we've been approved again. We're moving four hours from where we currently live and my husband is slated to start his new job that week. We had wanted to move in the middle of July, but the sellers refused to agree.

I would have your realtor push back and say they've had plenty of time to figure something out and need to be out aug 7th.

 However, I don't see why you can't close Aug 9th.  If they can get everything out at noon an then you do a walk through and close in the afternoon that should work out.

I would have your agent push back.  Also ask your lawyer who will be covering him when he goes out of town.  Then you dont have to wait til the 13th if they can and you agree to close on the 9th or 10th.

I agree with seeing if you can close by Aug. 9. I would personally have your realtor try for the 7th first of all--they've had many months to figure out their furniture. If it's an absolute no, then I would close on the afternoon of the 9th and let them know their furniture will need to be out that morning.

I agree, if you have to reapply for a mortgage after all this, I'd be tempted to just look for a new place.

We had something similar to this happen to us.  I called our lender who said they could extend mortgage date for a fee.  We told the sellers that we were willing to do this, but they would have to pay the fee and they magically were able to get their stuff out by the original date.

The sellers we purchased from did the same thing to us. So annoying! Initially they asked if they could leave a "few boxes in the garage" and pick them up the following morning. We were totally find with this. Then it became none of the furniture could be moved until 2 days after we were scheduled to close. Not ok. It really messed up our work schedule and move and we were pretty pissed about it. I still get heated just thinking about it. Good luck!
