So I got an email from our photographer this morning that is testing me today. He is supposed to be working on our album (that was included in our cost) for the past month. This morning he emails me and says, "I started working on your album last night. Ran into a problem. I lost all of your photos. Sometimes this happens".
Sometimes this happens!!! Thankfully he had sent us a disc of the photos (we got married in CA and live out of state) and we have them saved numerous times. But still....now I have to go back and figure out what photos we wanted, send them through some website I have never heard of and hope that he is actually doing them this time.

My mom thinks I should ask for a refund. What do you girls think? Right now, I just want the darn album and move on with my life!

I got into a bit of a fiery rage for you just reading this! How frustrating.
It might be tempting to ask for a refund now, but it's touchy because he still has to deliver something to you. If you make him angry, he might not give your money back OR finish the album. I would calmly explain that you were under the impression that he had been working on the album for weeks, and that it is an inconvenience for you to have to do the work all over again. Ask if he can do anything to compensate you for that.
My photog has been kind of flakey too and I have dealt with it by sending frequent follow up emails, asking him if things are getting done. He's working on our thank-you cards and album. I can't wait until it's all done.
I would ask for a refund, and if he refuses get legal advice.
You can make your own album on shutterfly, mixbook, picaboo or numerous other things (probably cheaper) and make it how you want and be done with this.
"sometimes losing pictures happens" is NOT acceptable for a pro photographer...my H is a photographer and he can still bring up every picture of every paid event for the past 2 years, just in case. Why did the photographer not sore them on multiple devices in the first place?
