  • I haven't even clicked on the link, but fukc that.  That should be grounds for terminating parental rights.

  • I believe there is a statue of limitations on how long he has to ask for parental rights. I'll have to ask H.

    That said, no judge in their right mind would take this seriously. At least, that's what I hope.

    Yes, because he plead to statutory rape. If it had been forcible, her uterus would have prevented implantation of course. Indifferent
  • I can see how the legal logistics of this could be... frustrating. Because by definition, a father who acknowledges a child and pays support has a right to visit his child. But.. this is something altogether different since it was forcible..

    I hope they find a way to deny his visitation request. Personally, if I were the girl I would say to heII with the financial support--just get him the eff away from me and my kid.

    IMO, paying child support doesn't give someone the right to visitation, but that's a whole other story.

    I pray the judge in this case has enough sense to see how fvcked up this is and denies his request.

  • Legally, visitation cannot be tied to child support (a parent cannot withhold visitation for non-payment).
  • Also, he plead to statutory rape, but the article never says if he was ever charged with any other form of rape and plead down. It's possible this (dumb, naive, young) girl consented (as much as a 14 year old can) to sex with someone who took advantage of her, but didn't forcibly rape her.  From the article, either could be true.  Both are wrong, but wrt parental rights, I do see that as a differentiating factor.

    Exactly, and paying child support does not guarantee visitation.

Yes, he was found guilty of statutory rape.  If it really were statutory rape (and let's face it, in the eyes of the law, it was statutory rape), then I think the mother has no case at all - he has a right to see his child.  I find it appalling that they think he doesn't have rights.

     Well, legally it was AT LEAST statutory rape, but it may have actually been more. People often plead to a lesser charge than what was committed.
