Update to my Employee Vent!!

I met this guy at the auto body shop that he picked out and he looked nice and then he turned into this money eating guy!!

He asked me, "How are you guys going to reimburse me?" 

And "I am going to need a rental car while my car is getting worked on?"

I explained to him, that we are very sorry and that no matter what we are going to pay for the damage of his vehicle. 

They finally came out with the total and it came out to $8,300, honestly his car is almost worth that much. I thought it was a newer car but its a 2004. The car shop he chose is owned by his friend. I feel like they gave me a really high estimate just so that I would pay and they would fix the car with like $3,000 and they would split the rest!

Anyway, I told him that my insurance would handle it and I made the claim right in front of him and gave him all the information. He then decided to go to the store that gives us the work and made a scene....

I just received a call from the general manager for that store and he told me that this guy was mad because he needed a rental car. First of all, the store doesn't have to be dealing with this. Second of all, I had already explained to him that no matter what, if my insurance didn't pay for his rental car, I would!! He is taking this way out of proportion!!!

I am so upset and tired of all of this. :( And yes, I know it was an accident,and we all have accidents, I'm just stressed! My employee is going to pay this guys rental car if my insurance doesn't cover it!

  • I think that's fair that the employee pays for the rental car if insurance doesn't. I mean that's why you have insurance so definitely go through them first, but there's always gonna be certain things they don't cover. If that was me and I backed a company vehicle into another vehicle I would expect to have to pay for something. I realize it was an accident but still. 

    And 8,300 for a 9 year old car, wow that does seem extreme. Can you get a quote from one more place just to have something to compare?

    I think that's fair right? Honestly if I was in the same boat I know they would make me pay for his deductible and his rental car if it wasn't covered by the insurance.

    I told the insurance agent that what they quoted was very high and didn't seem right and she told me they would send an agent out to do a quote. Hopefully they find out that it can not be that much to fix a 9 year old car.

  • What was the damage? If there's extensive body work, they may need to replace one or more panels on the car. Our 2002 Elantra was t-boned and the repairs were several thousand mostly in body work. My old roommate's '99 Volvo was rearended and although the damage looked minimal, they declared it totaled since repairs would be more than the worth. Headaches all around. I hope it all work out!

     

     

  • Why are you offering to pay out of pocket when you have insurance?  That's why you have insurance- so they can handle things.  You shouldn't be offering up anything besides your insurance company's information.

    Also, the company is responsible for company property and for insuring it.  Employees are not responsible for insuring, maintaining, purchasing, etc company cars.  It doesn't seem like the employee should have to pay.

    I think I'd probably quit if the company I worked for suddenly made me responsible for the cost of any equipment I use.

He admitted fault, you have insurance and this is why you have it. It protects not only YOU buy your EMPLOYEE also.

    You are irritating the heck out of me. I'm laughing that you are so stressed about this, try explains to a customer that their car is totaled while out on a test drive.

    LOL your siggy freaks me out! The look on his face is EPIC!! 

    Also, the damage isn't $8300 bad, it was just the hood and the bumper. We honestly think that his repairs should only be around $3000 and that includes paint and labor. 

    The good thing is that our insurance is sending an agent out and he will do the estimate and our insurance will only pay for what he estimates and the rental cars. I'm not worried anymore it just sucks having to do all of this you know? But it's life and it comes with owning a business. 

    FX for a better week next week :)

    Oh yes, our insurance is going to do another estimate and pay for what they estimate. I'm just glad I'm not dealing with this anymore and my insurance is taking care of it now. Just sucks that it fell on the weekend but that's the least of my worries

    Thanks for your opinion but like I said, everything is covered and no one will be paying anything out of pocket and we won't be getting sued. I honestly appreciate what you're telling me and I get what you're saying but the insurance is now taking care of this and hopefully we will not have problems like this again (although I know sh!t happens).

    And it's really good that your insurance will cover the rental car.  Because if you tried to make the employee pay, you'd be setting yourself up for a giant lawsuit and you'd lose. You can't legally make your employee pay out of pocket for damages occurring with company equipment during the course of performing his job duties.  If you could, no one could accept any job without getting themselves a personal liability insurance policy.  This is why businesses have insurance packages.  I'm saying this as a former commercial insurance broker with a background in legal.  Just in case the situation or a similar one happens in the future.  You're right that everyone is entitled to their opinion.  But your opinion doesn't mean squat to a judge when it's not in compliance with the law.

  • I hear all these people saying the employer is responsible for everything. I am a speech language pathologist who works for a company that gives us ipads to use to do our paperwork and clock in. My company made each of us sign a paper saying we would be responsible for the ipad if anything happened to it. We had to sign the paper to get the ipad and we would be considered out of compliance if we didn't use the ipad. I am not sure if it would really hold up, but I do think they would deduct from or paycheck if we damaged it in some way.

    This is a completely different issue than the one the OP is talking about. I'm sure they would charge you for the iPad. However, working for a company that uses vehicles as part of the job is a different issue than what your work is.

    It has to due with the way the insurance is handled. Your company does not have insurance on the iPads, your home owners insurance will not cover the iPad because it is owned by your company. They had you and other employees sign for the protection of the companies property. Most companies issue iPads, laptops and cell phones to employees. Each company has a it's own policy when it comes to replacing damaged, lost or stolen equipment.

    If you can't understand the difference in these situations you may want to talk to your boss. My H had his company laptop stolen out of his office with other employees having wallets and other items stolen. His company did not have him pay for the loss on the laptop they paid for a new one, if it had been stolen out of his vehicle instead he would still not have had to replace it. All office equipment was coved under his companies insurance but that is just the policy they had.  

  • Just another thought.  Companies tell the employees things all the time. They also have them sign things all the time.  However, it doesn't mean that what they tell you or have you sign doesn't go against state/federal law.  Granted, you might have to go to court to fight it.
