So I've got a dilemma and was wondering what would you guys do.

I plan to be a stay at home mom after Lily is born.  I've got 5 weeks of sick and vacation time saved up.  We do not get paid maternity leave.  We have to use our saved time off to cover maternity leave.  Our HR policy says that we have 30 days after being released from the hospital to notify work if we plan to return or not.  So I was going to wait the 30 days and then notify them that I'm not returning.  This way I can use my time off and still get paid for that extra month.

My dilemma is that since the budget is so tight my boss is not going to hire a temp while I'm out (I just found this out yesterday).  She is just going to try to cover for me until I get back.  The reason they created my position was because she couldn't keep up.  It took me months to get everything caught up after I started.  Part of that was the learning curve.  I'm feeling so guilty about waiting to let them know I won't be coming back.  It puts the next person they hire behind because I know my boss won't be able to keep up.  But if I tell them now that I'm not planning on coming back I wouldn't be able to take maternity leave and then I wouldn't get my 3 weeks of sick time paid out, only the 2 weeks of vacation.  

To add to the top of it, my boss is throwing me a baby shower at work tomorrow and I feel sort of awful about everyone I work with buying me gifts when I'm not coming back.  I've been here for almost two years and if it were someone else I'd still buy them something.  So I shouldn't feel guilty about this part.  But I do. 

Would you tell your boss now about not coming back or would you take maternity leave and your sick time pay before notifying them?

    It's like my HR person said to me.  You need to do what's right for you.  I'd at a minimum take the sick time and then let them cash out the vacation pay.

  • I fully agree with Mark on this one. Do what is best for you. It is not your problem if your replacement ends up behind.

  • I also agree with what Mark said. I know it's hard not to feel bad or feel guilty but you have to do what's best for you and your new family! Good luck!

  • Mark is spot on with this. Use up your 3 weeks of sick time and then notify them that you do not intend to return to work. Your boss has a 2 week head start on finding your replacement and you'll get to keep your sick and vacation time.

    I am way envious of your being able to be a stay at home mom! Hopefully by the time we have number 2 I can stay at home.

  • Thanks everyone!!!  Hubby has been saying the same thing.  I was also in total agreement because at the time I thought they were getting a temp to fill in while I was out.  When I found out yesterday that they weren't, it just made me feel bad.  But you are right, it's what's best for me.

  • Just as an addition, I mentioned letting them cash out the vacation pay.  That really depends on how your work handles that and if you need the benefits that being "employed" give you.  I know at my work, vacation cash outs have less withholding taken out as only taxes are taken out, but not benefit deductions.

    That's a great point.  I was originally planning to take the full 30 days and then get a pay out of what was left of my vacation.  But I think letting them know after my 3 weeks of sick time is a nice compromise.  I won't wait the full 30 days but I still get all my time paid out.  Paul is going to add me to his insurance when Lily is born so I'll technically have double coverage for those 3 weeks.
