Can someone smarter than me explain this please?

The proposed Kentucky bill that would require welfare recipients to pass a drug test...that's unconstitutional, right? Unreasonable search and seizure? Or am I interpreting that incorrectly?

  • IF I HAVE TO TAKE A DRUG TEST FOR MY JOB, YOU HAVE TO TAKE A DRUG TEST FOR WELFARE.  At least that's the rumor around facebook statuses a while back.

    Yeah, didn't they pilot this in Michigan in the 90s?  And it didn't work AT ALL because so few of them were on drugs, the cost/benefit ratio was outrageous.

    I'm with you Bob, I think unreasonable search and seizure. And also ridiculous.

    But I guess drawing a comparison to Fallin's argument re:  the TSA, welfare/assistance isn't a right, so you can choose not to take it and not be tested.

    Yes! HuffPo had a great article about that the other day. Like less than 10% of the recipients tested positive for drugs and all but 3 of those were marijuana. Didn't we learn this 20 years ago? The "welfare crack queen" is just a myth!

    This was prompted by FB, by the way. Tim's crazy cousin posted this last night (and dude, it's not even true, the law didn't pass yet):

    Kentucky just passed the best law ever. To be on foodstamps, medicaid, or cash assistance for your children or yourself, you have to pass a DRUG test. Now every other state should do the same. If you agree re-post!

  • I know some people that are on welfare and abusing it and those that are on drugs are about 50/50. The one dude is even in jail for possession with intent to sell.

    You can roll your eyes all you want, but I'm just saying that it is probably more prevalent than you think. We drug test for work and it isn't all that expensive to do a drug test vs. handing out hundreds of dollars a month, I'm not sure it would be so much money wasted vs. saved.

    From what I hear, one of my friends is abusing the shiit out of the system. She is married and claims she is not and no one even checked. I think there are far more cases of fraud like this than drug abuse. 

    I think the cost of checking into all of this would still be higher than the money gained back, but in the case of hiring more workers to investigate at least it would create jobs.

    The drug testing makes no fiscal sense no matter how you bend it.

  • UGH. I can't stand when someone gets on this rant on FB. Most likely, it's someone I went to HS with or a friend of my roommate. I just bite my tongue, hide them, and move on, but it's tough to not engage.

    I agree with what everyone else has said, and I will add I find it funny that this comes from the same school of thought that wants "smaller government." Um, yeah.

  • Cash strapped states have all kinds of extra money and personnel sitting around, ready to implement these laws.
  • I vaguely remember hearing that CA was going to make the crack welfare mom's work to keep their benefits. Maybe they can administer the tests for minimum wage? Unemployment is high. Should be a win-win right?

  • Coke and crack and meth stay in your body for like three days, four days MAX. Often less. Either we hire thousands of people to do drop-by home testing (which would be fucken DANGEROUS, too) or everyone doing the harder drugs abstains for a few days (which is hardest for people with the true illness of addiction).

    This is probably why that 3% is so low, but also why drug testing to catch crackheads and methmouths is utterly pointless.

I suspect conservative justices would say that there is no right to state aid and people opt into receiving aid so ok.  On the other hand, this is a bit distinct from flying.  I mean, you have to eat, right?  And have shelter and feed your kids.  Only the most cynical cynics really think most people choose to be on welfare because the cheese is just that damn good.  So, I'm not sure how voluntary submission to the search really is.

    The bigger problems to me seem policy based.  The cost/benefit issue.  If people test positive, is the state going to provide rehab (which works so well when forced) or toss people out on their asses?  Cities love street beggers, right?  And that won't up the crime rates, I'm sure. More, WTF do you do about the kids whose parents test positive?  Sorry, little Timmy, but daddy is an addict so no milk for you?  Foster care? Yeah, that system isn't effed up or expensive for the state.

    I know of this one woman who implanted 8 effing embryos, so my insurance monies definitely shouldn't go to pay for anyone's fertility treatments.
