Yah I'm lost on that too.
The judge has said at least one other time that he can't ask about the picture since it's not in evidence.

I believe this means.. they did not give the picture to evidence to the court. If they have any evidence, they have to hand it over to the court and then if they approve it to be used, both sides need to be able to view it and prepare for it. You can't just pull any type of evidence out of your briefcase and say, ta dah! a bloody knife! You have to enter it as evidence and it be accepted in order for the jury to be able to know about it and use it to influence their opinion.
I'm not any expert but my H used to be a public defender and did about 50 trials so I've heard a lot of legal jargon in my household for the past few years.

The jury is cute with the Lightning game question. I hope they can make that happen for those pour souls.
The question about alternates makes me wonder if some of them are already getting bored and looking for the okay to tune out. The journal question was interesting, I haven't heard that one before. I thought the judge handled it well. I like him.
My curiosity is piqued with the security question he will answer in the jury room. I wonder if some of them feel unsafe or what.

What are the alternates for? Obviously to replace original jurors, but for what reasons are jurors excused? I would hate to be an alternate...stuck in orlando for umpteen million weeks and your thoughts possibly not even counting.
Alternates don't get to vote guilty or NG, right?

No, the alternates don't get to vote. They are just there as replacements if they are needed. In a trial of this length, there are a number of reasons a juror might drop out - misconduct (discussing the case, etc), illness, other unforeseen circumstances. I'm sure they won't need all the alternates (if any), but better to have a lot than not enough and have to start the trial over. I think the most alternates I've ever seen actually used in one case was three. We had six if memory serves, so that was fine.

Cool. We are both wife's of H's on both sides of the fence. My H is a board certified criminal trial attorney who was a prosector turned defense attorney. I hear the jargon in my house a lot too.
As for the picture, the state brought it up I believe first, which is why I thought it was in evidence. If it isn't I'm not sure why they keep showing it.How can they keep showing it if it isn't in evidence? Confused.
ETA - Where did your H go? Did he leave to the public side of law? Public Defenders and Prosecutors are SO overworked, but H is still getting home at crazy hours doing his own thing now.

Thank you! I was wondering if there was info about the jury floating around.
How on earth Juror 12 got on there is beyond me. Holy bad juror, batman (from a defense standpoint, of course - she sounds like a great prosecution juror!). There are a couple others in there, too, that the defense side of me bristled at. But, I was surprised at how many anti-DP jurors they had. Of course, I know that a lot of times people say they are "absolutely against the death penalty...except for murder/abuse of a child." So we'll see.
Man, I would love to talk with these poor people after the case. I don't envy them, that's for sure.

I've been wondering that too. The only thing I can come up with is that they had duct tape on them, which matched the duct tape found on her mouth. But if George admits to putting the duct tape on them himself, I'm not sure why it's important that they were stolen, that Casey took them, etc?

I defintely am not understanding the correlation w/ the gas cans.
I get the duct tape; bc caylee had duct tape on her.. but i'm not understanding how duct tape on the gas can has anything to do w/ duct tape on caylee.. so it was in the house...anyone would have had access to it..

State calls next witness Ricardo Morales. Casey's ex boyfriend.
Says Casey worked at Orlando giving tours to people from out of town (um... 99% of disney attendees) Said Casey talked about 2 specific employers from Disney.

Talked to H about evidence - he said the state doesn't have to put something into evidence if it is use for demonstrative purposes. however, if somethign isn't in evidence the jury can't take it back for consideration in the case.
this is sad. i need to stop following this case.
but, if the defense keeps asking q's about a gas can that isn't in evidence, then the jury can't consider that as facts? I don't know. This law stuff is complicated.

Reading through the info on the jury, Alt. #3 clearly isn't lying that she hasn't been tainted by news coverage. She says she hopes Casey didn't do it and that she was hoping they would find the little girl alive.
Was she speaking in past tense?
The juror backgrounds made me laugh. especially the fact that they kept the baseball ticket guy.

Sometimes the stuff jurors say makes me really sad. How people can be so unaware of the world around them is amazing.
Some people just don't follow local news (or national) for that matter. But, when I've done terrorism cases, I've come across people with shockingly little knowledge even of 9/11. Dude, how does one ignore THAT??? You really have to live in your own little bubble for that to even be possible.
I've always said if I was ever on trial, I would waive my right to a jury. People are crazy.

Usually they just fill the first 12 actual jurors then the alternates...so they just pick 18 people then the first 12 are the jury and second 6 are the alternates. They don't assign people to either alternate or juror status individually, if that makes sense.
Of course, every place does it differently so who knows for sure in this case.

The more you talk about your job, the more fascinated I am by it!
As far as choosing a jury, I think it depends on what you are on trial for. I'm sure you saw the not guilty verdict for the two NYPD officers in that rape trial today. Now there's a case where stupid jurors probably saved two guilty a-holes.
I did. I was very surprised. Jurors are just a crapshoot, you know? Obviously, I don't often get to know what goes on in actual jury rooms unless the jurors are willing to talk with attorneys after the fact. The best idea I have comes from mock trials, where we present a case to the mock jury and then watch them as they deliberate through a video feed. It is fascinating the stuff they pick up on, the stuff they ignore, and the stuff they flat out seem to have just made up. I have wanted to bang my head on the desk countless times as I watch these things because they will all be SO FOCUSED on some random point that often, they are remembering incorrectly. They all want to do a good job, of course, but sheesh. Sometimes it's just absurd the way things actually go down.
That's why I haven't counted Casey Anthony out just yet. Do I think she'll be convicted? Probably. But the fact is, Baez only has to make sense to ONE of those 12 jurors, and he only has to make enough sense to give them a little bit of doubt. If that one juror is strong-willed enough, he could actually pull off a hung jury at least. You just never know.
