How to file for divorce or Legal separation?
What's the difference between a divorce and a legal separation?
Do I need a lawyer? Should we both file or just one files and the other respond? It seems like DH is pushing me to be the one to file first. Why?
We have no children, no assets or joint accounts together.
Re: How to file for divorce or Legal separation?
depends on your state...some states have a mandatory separation period before you can file for Divorce (PA for example)
In NJ i was able to file right away. I filed for a no fault, uncontested divorce. the county court had forms and instructions (if you call them) for those who want to file pro-se.
I just got my forms on-line (the complaint, affidavits, instructions, etc, and the MSA) for $89. We had seperate accounts, no kids, we agreed i'd get the house and agreed on asset separation (which was all written up and notarized in the MSA that we submitted to the court)
it was a very easy process for me because he didn't contest it. (it took 10 days from the time i filed the papers to be divorced)
you can google your state's divorce laws
