    But what if it was "self defense?"  I'm not saying it's right - not saying that at all.  I am just thinking that's why he hasn't been arrested.

    Because you arrest suspects, and then later it's decided if self defense was really what happened.

    This.  I'm pretty sure they barely even questioned him.  No excuse whatsoever for the way this case has been handled.

    Yeah, the fact-finding on whether it meets the criteria for self defense (even under FL's batshit crazy self defense laws) is something done during trial. You know, a jury of your peers and all that. Not the police declining to care/do their job because a white racist guy happened to shoot a black kid. 

    If even a sliver of the story as it's being reported is true, this guy committed a crime under FL law and basically every state's law, unless there is a state I'm not aware of that allows you to claim that a bag of skittles put your life in danger.

    I hate to even step into this, because I am seriously sofuckingbeyondpissed that this racist ** hasn't been arrested yet, but I have to say something because I've even been hearing it on the news, and this just isn't true - not in FL. 

    I posted a link to the actual FL self-defense law in a prior thread, but basically, the law doesn't create an affirmative defense (which is where you would arrest someone, then at trial they would use this as a defense), it creates an immunity. And the law specifically states that you CANNOT arrest and then ask questions later. The police are charged with investigating AND THEN arresting if self-defense wasn't what happened.

    The problem here isn't that the officers didn't arrest GZ right away. It's that they didn't arrest him after even a cursory investigation showed that there is NO WAY IN HELL that this is self-defense.

  • Thanks for that, arborgold.  I'd heard something along those lines, but it was so 3rd hand it didn't make sense.

    I can see why they didn't arrest him right away, but they really should have quite quickly.

    Although, given the reports that they refused to talk to some witnesses, and they corrected another, it seems their cursory investigation would still conclude self defense.

  • This Miami girl has always loved my Heat (H even worked for them for a while, natch!)...but I love that team even more now than I did this morning.

    More than just the photo, I love how the organization and the coach are standing behind the players for taking the photo. The team released a statement in support and Spolstra was asked about it and commented on the photo. No one's come out and said, "The views of the players are solely their own..." or some other corporate PR bullish line.

    Love those guys, just love 'em.

    Now, if you want to be seriously disturbed, search for the story in the three local South Florida papers and read the comments. Yes, racism is definitely dead now that the US has a black president...Confused
